Following the 2013 Legislative Session there was a commitment by Assembly Speaker Marilyn Kirkpatrick to work on contractual indemnity issues with both the residential homebuilders and subcontractors. It has been a year and a half of hard work, thoughtful discussions, all layered in with a dramatic change in Nevada’s legislative leadership. Through it all, we couldn’t be prouder to share with you Assembly Bill 1 (AB1), which was prefiled recently.

This bill, co-sponsored by Assemblywoman Kirkpatrick (D-Clark AD1), Assemblyman Ira Hansen (R-Washoe AD32), and Senator Ben Kieckhefer (R-Washoe SD16), represents a historic moment in Nevada history. Nevada is one of a few States that has not addressed Residential Indemnity from a public policy standpoint. The process now will have Assemblywoman Kirkpatrick introducing AB1 when the session convenes February 2, 2015. The bill will receive a hearing in both houses and need to pass out of both the Senate and Assembly before heading to the Governor’s desk.
We continue to work on language with the Homebuilders that will, finally this session, lead to meaningful Chapter 40 reform. This compromise language is in its final draft. From there it will be presented to the Legislative Council Bureau (LCB) who has the responsibility of preparing our bill draft for introduction. NRS Chapter 40 was enacted into law during the 1995 session … the NSA has never wavered in discussions with lawmakers that Chapter 40 is a flawed and corrupt system that does nothing to make the homeowner whole. It’s because of your support, involvement, focus and determination that we are carrying these two pieces of compelling legislation into the 2015 session.
